Commercial insurance cancellation notice
A business holding a cancellation notice on its commercial auto policy has until the notice's effective date to pay, dispute the reason or bind replacement coverage. Utah Code 31A-21-303, in the version in force since May 7, 2025, sets the floor: a commercial policy cancelled for nonpayment ends no sooner than 10 days after the written notice, and one cancelled on other grounds no sooner than 30 days after. A nonpayment notice must state its reason; when a notice leaves out the facts, the insurer sends them within 10 working days of a written request. A policy under 60 days old and never renewed can be cancelled on 10 days' notice.
What happens when an insurance company cancels your policy?
A cancellation notice ends a commercial auto policy before its term is up, on the effective date the notice prints, and the policy period ends that day. ISO's Common Policy Conditions IL 00 17 11 98, the cancellation condition on commercial policies written on ISO forms, say "Notice of cancellation will state the effective date of cancellation. The policy period will end on that date," and add that "If we cancel, the refund will be pro rata."
Utah Code 31A-21-303, in the version in force since May 7, 2025, sets how early that date can fall. A commercial policy cancelled for nonpayment of premium ends no sooner than 10 days after the written notice is delivered or mailed first class; a cancellation on any other ground takes effect no sooner than 30 days after. A non-renewal is a different notice: under 31A-21-303(4)(b)(i) the insurer sends a notice of intention not to renew at least 30 days before the policy expires.
| Cancellation | Earliest effective date | Reason rule | Subsection |
|---|---|---|---|
| For nonpayment of premium, commercial policy | 10 days after delivery or first-class mailing | The notice states the reason | (2)(c)(iii), (2)(d)(i) |
| On grounds: misrepresentation, change in the risk, breach, licence suspension | 30 days after delivery or first-class mailing | The notice states the facts with reasonable precision, or the right to ask for them | (2)(a), (2)(c)(i), (7) |
| Of a policy in effect under 60 days and never renewed | 10 days after delivery | None: subsections (2)(a) to (2)(d) and (7) do not apply | (2)(e) |
Can an insurance company cancel coverage mid term?
After a policy's first 60 days, a Utah insurer can cancel commercial auto mid-term only for nonpayment of premium or one of four grounds in Utah Code 31A-21-303(2)(a). Section 31A-21-303, in force since May 7, 2025, says an insurer "may not cancel an insurance policy before the earlier of" the end of the agreed term or one year from the policy's effective date, except for nonpayment of a premium when due or for grounds. It reaches policies issued on forms subject to filing under Utah Code 31A-21-201(1).
A new policy is the exception to the grounds rule in Utah Code 31A-21-303(2)(e): subsections (2)(a) through (d) "do not apply to any insurance contract that has not been previously renewed if the contract has been in effect less than 60 days" when the notice goes out, and that cancellation "may not be effective until at least 10 days after" the notice is delivered. Subsection (11) keeps a separate remedy: the section "does not alter any common law right of contract rescission for material misrepresentation."
The four grounds for a mid-term cancellation in Utah Code 31A-21-303(2)(a), in force since May 7, 2025, are these:
- Material misrepresentation on the application or in the policy file
- A substantial change in the risk assumed, unless the insurer should reasonably have foreseen the change or contemplated the risk when it wrote the policy
- Substantial breaches of contractual duties, conditions or warranties
- For motor vehicle insurance, revocation or suspension of the driver's licence of the named insured or of anyone who customarily drives the vehicle
Is my insurance still active after a notice of cancellation?
A commercial auto policy stays in force from the day a cancellation notice arrives until the effective date the notice names. For a nonpayment notice on a commercial lines policy, Utah Code 31A-21-303(4)(e)(i)(B), in force since May 7, 2025, says that from the notice until the premium is paid, "coverage exists and premiums are due." A renewal premium is the exception: under 31A-21-303(4)(e)(ii)(B), a commercial policyholder who does not pay it within the 10 days loses coverage as of the day the renewal premium was first due.
Utah Code 31A-21-303, in force since May 7, 2025, sends a nonpayment cancellation notice to people besides the policyholder. The commercial notice goes to each assignee named in the policy and each loss payee, mortgagee or lienholder under property insurance named in the policy under (2)(c)(iii); a copy goes to the agent of record on or before the day the policyholder gets it under (2)(c)(iv); and a motor vehicle policy's lienholder is notified under (8)(a) if the insurer has its name and mailing address.
Federal filings run on their own clocks for a carrier with an FMCSA filing. Under 49 CFR 387.313T(d), that carrier's certificate of insurance on file with FMCSA is not cancelled "until 30 days after written notice has been submitted to the FMCSA" on Form BMC-35. Under 49 CFR 387.7(b)(1) for a for-hire interstate property carrier and 387.31(b)(1) for a for-hire interstate passenger carrier, the required policy and endorsements end on 35 days' written notice. A Salt Lake City ground transportation business must also send the city's department a copy of any notice of cancellation immediately upon the cancellation, under City Code 5.71.140(C) (Ord. 66-14, 2014).
How do I find out why my insurance was cancelled?
Utah Code 31A-21-303 makes the insurer state the reason for a nonpayment cancellation and send the facts behind its decision within 10 working days of a written request. Subsection (2)(d)(i), in force since May 7, 2025, says a nonpayment notice "shall include a statement of the reason for cancellation." When a cancellation notice does not state "with reasonable precision the facts on which the insurer's decision is based," subsection (7)(a) has the insurer mail or deliver them within 10 working days after it receives the policyholder's written request, and (7)(b) makes the notice ineffective unless it tells the policyholder about that right.
Utah Code 31A-21-303(9) adds one more line: if a risk-sharing plan under Section 31A-2-214 exists for the coverage, the notice is not effective unless it tells the policyholder how to apply to that plan. Section 303 does not name the plans it means.
Four things on a Utah cancellation notice decide the next step:
- The effective date, and whether it falls at least 10 days (nonpayment) or 30 days (other grounds) after the mailing date
- The reason, or the statement of the right to ask for the facts
- Any instructions for applying to a risk-sharing plan
- Whether the notice went to the lender, assignee or loss payee named in the policy
What can you do if your insurance company cancels your policy?
A cancellation notice leaves three paths before the effective date: pay and ask the insurer to keep the policy, correct the insurer's facts, or bind replacement coverage. Each path rests on Utah Code 31A-21-303, in force since May 7, 2025, or on FMCSA's filing rules in 49 CFR 387.313T.
- Nonpayment: Utah Code 31A-21-303(12) counts a mailed premium as paid on the postmark date and an electronic payment on the day it is made. Section 303 does not say whether paying a past-due installment withdraws a mid-term cancellation, so get the insurer's answer in writing before the effective date.
- Grounds you dispute: ask in writing for the facts under 31A-21-303(7) and send the insurer the correction. The Utah Insurance Department's complaints page, read October 12, 2026, says a policyholder unable to resolve a problem with an insurer or agent may contact its staff or file a written complaint.
- Replacement: bind a new policy whose start date is no later than the cancellation's effective date, so the vehicles are never uninsured between the two.
- Assigned risk: call the Utah Automobile Insurance Plan Office at (800) 227-4659, the number AIPSO's Utah plan page, read October 12, 2026, lists for consumers looking for assigned risk coverage; the same page names National Specialty Insurance Company as the commercial auto servicing carrier since September 1, 2022.
What should a replacement commercial auto policy include?
A replacement commercial auto policy starts no later than the cancelled policy's effective date and carries every limit, filing and named party the old one carried. ISO's IL 00 17 11 98 says the cancelled "policy period will end on that date," so a later start leaves the vehicles uninsured for the days between.
Three checks set what the replacement has to carry:
- Limits: Utah Code 31A-22-304, in its current version, sets $30,000 per person, $65,000 per accident and $25,000 property damage on a policy issued or renewed on or after January 1, 2025; contracts and filings can require more.
- Federal filing: for a carrier with an FMCSA filing, 49 CFR 387.313T(e) ends the retiring insurer's liability on the effective date of a replacement certificate FMCSA accepts.
- Named parties: a Salt Lake City ground transportation business names Salt Lake City Corporation as an additional insured in all insurance contracts under City Code 5.71.140(D) (Ord. 66-14, 2014).
What do you send to replace a cancelled commercial auto policy?
Replacing a cancelled commercial auto policy starts from six things: the notice, the current policy, the loss runs, the vehicles, the drivers and the USDOT record. Send the list below by text before the effective date; the first reply is a conversation about the notice, the cover the vehicles need and the date the new policy has to start.
- The cancellation notice, with its reason, its mailing date and its effective date
- The current declarations page, or the dates of prior coverage
- Loss runs from the current insurer
- Each vehicle and trailer: year, make, model, body type and value
- Every driver: name, date of birth, licence number and class
- USDOT number, and the MC or docket number if any, with the vehicle and driver counts on the SAFER record
Can an insurance company cancel without notice?
Not a Utah policy on filed forms. Utah Code 31A-21-303(2)(c) and (2)(e), in force since May 7, 2025, require written notice delivered or mailed at least 10 days before a nonpayment or new-policy cancellation takes effect, and 30 days before one on other grounds.
Can I cancel my own commercial auto policy?
Yes, under ISO's IL 00 17 11 98 the first named insured cancels by mailing or delivering advance written notice, and its refund "may be less than pro rata." A carrier's own forms may differ.
