FMCSA insurance filing

An FMCSA insurance filing is the proof your insurer or surety files with FMCSA, on your behalf, that the coverage 49 CFR Part 387 requires is in force. A for-hire motor carrier's liability filing is a BMC-91 or BMC-91X, or a BMC-82 surety bond. Household goods carriers add a BMC-34 cargo filing, and brokers file a BMC-84 bond or BMC-85 trust fund. FMCSA will not grant operating authority until the filing is on record. FMCSA retired filings through its old L&I system on May 14, 2026, and its Motus FAQ says insurers will submit filings in Motus. The MCS-90 is an endorsement on the policy, not a filing.

Which insurance filing does FMCSA need for my operation?

FMCSA's filing chart answers it by entity type. The chart's motor carrier rows, property and passenger, all list the same liability filings: BMC-91, BMC-91X or BMC-82, the BMC-82 being the form used "When surety bonds are used rather than certificates of insurance." Household goods carriers add a cargo filing; brokers and freight forwarders file a bond or trust fund instead.

Only household goods carriers and forwarders file cargo: 365.109T lists the BMC-34 for "household goods motor carriers and household goods freight forwarders," and on every other row the chart prints $0 in its cargo column and lists no cargo form. Brokers file a BMC-84 bond or BMC-85 trust fund under 387.307. The limit each filing certifies comes from 387.9 and the chart; the $750,000 figure is for for-hire, interstate, nonhazardous property in vehicles of 10,001 pounds GVWR or more.

Who files insurance with FMCSA, and can I file it myself?

Your insurer files it. FMCSA's filing page says "a financial responsibility provider must file the appropriate insurance form(s) on behalf of the applicant," and its Motus FAQ defines those providers as insurance companies, surety companies or financial institutions "that register with FMCSA to file proof of insurance." Under 387.323T, "Each insurer must obtain authorization to file electronically by registering with the FMCSA."

So "how do I file insurance with FMCSA" means: buy the liability policy from an insurer that makes federal filings, and give it the exact legal name, address, USDOT and MC numbers on your application. FMCSA tells new applicants to request the filing "immediately after obtaining their designated docket number." Redoubt compares carriers "to get you covered and your MC authority activated"; the insurer transmits the filing.

What is the difference between BMC-91 and BMC-91X?

Aggregation. 387.313T says a BMC-91 is filed "for the full security limits," while a BMC-91X "will be filed to represent full coverage or any level of aggregation." When insurance from more than one insurer is aggregated to reach the limit, the rule requires a separate endorsement and BMC-91X "of each insurer," and the electronic filing layout marks each one "P or E," primary or excess. A carrier whose limit is stacked across insurers needs BMC-91X filings; the rule also lets an insurer use a BMC-91X for full coverage.

Neither is the MCS-90. FMCSA's chart lists the MCS-90 for all for-hire and interstate motor carriers as an endorsement form, and 387.7(d) keeps that proof at the carrier's principal place of business. Progressive's filings page, read October 3, 2026, says "The BMC-91X filing is submitted to the FMCSA as certification that the MCS-90 endorsement has been issued." The 387.313T and 387.323T rules quoted on this page are the T sections eCFR prints in force; their unsuffixed versions are marked suspended, and FMCSA's chart still lists these forms.

How long after my application is published does the insurer have to file?

Twenty days from publication in the FMCSA Register; after that, FMCSA serves a decision that the application will be dismissed unless the filing arrives within 60 days. In FMCSA's words: "If the entity fails to comply within 20 days from the date of publication in the FMCSA Register, an FMCSA decision will be served notifying the entity that their application will be dismissed unless they comply with the requirements within 60 days." 365.109T, the rule in force, gives the same 20 days for the filing and the BOC-3. The older 365.109 says 90 days, but eCFR marks it suspended since January 14, 2017.

Until then nothing activates: FMCSA "will not grant operating authority registration" until the coverage is on file. How long a filing takes to post once the insurer sends it has no published figure: FMCSA's filing page and 365.109T, both checked October 3, 2026, give none. Bind early enough for the insurer to file inside the 20 days.

How do insurance filings work in Motus?

FMCSA's old L&I site says "changes and filings via L&I (Public)" were retired on May 14, 2026, and its Motus FAQ says insurers "will be able to use the new system to submit the required financial responsibility filings, similar to the way they are electronically filed today." Old L&I records, FMCSA says, "will remain available for viewing and verification."

Redoubt has seen a market hold the filing for the carrier's Motus record. In a September 2026 email to Redoubt about a quote, the market wrote: "The insured will not be able to get their filings until they update their MOTUS site to show 3 drivers."

What filing mistakes hold up an MC authority?

Mismatches between the policy, the filing and FMCSA's record, in the cases FMCSA warns about and one Redoubt has seen. Check these before the filing is requested.

  • A name or address on the authority application that does not match your secretary of state filing. FMCSA says "Any deviation results in the delay of granting of the authority," and 387.313T requires the filing in the "full and correct name" of the carrier.
  • The wrong docket number. The electronic filing identifies the authority by the "FMCSA Assigned MC or FF Number."
  • A filing that does not fit the operation, such as a household goods mover with no BMC-34 cargo filing.
  • A policy written for a different operation. A September 2026 prospect note in Redoubt's file records that a Texas hotshot carrier's insurer "wrote him as a freight forwarder instead of general freight, so the federal filing is held up."
  • Nobody watching after activation: "It is the entity’s responsibility to monitor and maintain filings up to date and on file."

What is a Form E or Form H filing, and does Texas require one?

They are the state versions, filed by the insurer with a state agency, not FMCSA. Form E, a uniform form set by the National Association of Regulatory Utilities Commissioners, certifies liability coverage for "the obligations imposed upon such motor carrier by the provisions of the motor carrier law of the State." Form H does the same for "cargo insurance," and Form K cancels either, no sooner than "thirty (30) days after the actual receipt of this notice by the Commission."

Texas takes them for intrastate carriers. TxDMV says its forms "must be filed electronically by your insurance company underwriter": Form E for liability, Forms H and I for cargo, Form K to cancel, and "Only your insurance company can file proof of insurance or cancellation." TxDMV's "All Others" row, for carriers not in its hazmat, household goods or bus rows, sets $500,000 for private or for-hire carriers over 26,000 pounds, its cargo table is headed for household goods carriers, and it lists a $100 Form E filing fee. The carrier still has to make sure its record "stays “Active.”"

Utah's UDOT rule R909-1-4 sets $750,000 for an intrastate private carrier but names no state filing form, and it states no figure for intrastate for-hire general freight; that minimum is an open question.

What happens to the filing when I cancel or switch insurers?

A filing stays on record until cancelled on FMCSA's form. Under 387.313T it "shall not be cancelled or withdrawn until 30 days after written notice has been submitted to the FMCSA," on a BMC-35 for insurance or a BMC-36 for a bond, counted from the day FMCSA receives it. That is the T section eCFR prints in force; eCFR marks the unsuffixed 387.313 suspended indefinitely, and FMCSA's filing page prints no BMC-35 instructions of its own.

To switch insurers without a gap, have the new filing take effect first: the old insurer's liability "shall be considered as having terminated as of the effective date of the replacement certificate." If nothing replaces it, FMCSA's Motus notice is plain: "If the registrant fails to maintain evidence of the required level of insurance coverage on file with FMCSA, its operating authority will be revoked or suspended involuntarily."

Frequently asked questions

Is the BMC-34 still required?

Only for household goods carriers and household goods freight forwarders, per 365.109T and FMCSA's chart. For the other for-hire property carriers the chart prints $0 cargo and lists no cargo form.

Is a BMC-91X the same as an MCS-90?

No. The BMC-91X is a certificate the insurer files with FMCSA, and the chart lists it as one of three alternatives: "BMC-91, or BMC-91X, or BMC-82." The MCS-90 is an endorsement on the liability policy, which the chart lists for "All For-Hire and Interstate Motor Carriers."
