Lapse in business insurance
A business whose auto policy lapsed has no cover from it after its end date; Redoubt asks for the gap's dates, its reason and the papers behind them. The ISO CA 00 01 11 20 business auto form covers accidents during the policy period shown in the declarations. Utah Code 41-12a-301(2)(a) requires a resident owner to keep security in effect any time the vehicle is operated on a highway, quasi-public road or parking area in Utah. Utah Code 31A-21-105(2) lets a misrepresentation affect the policy when the insurer relied on it and it was material or meant to deceive. For a for-hire carrier, 49 CFR 387.313T(d) bars cancelling a federal filing until 30 days after FMCSA receives the BMC-35.
What happens if business insurance lapses?
A lapsed business auto policy covers no accident after the end of the policy period shown on its declarations page. The ISO business auto form, CA 00 01 11 20, covers "accidents" and "losses" occurring "During the policy period shown in the Declarations," so an accident after the old policy's end date falls outside the old policy.
Utah's security duty runs with the vehicle's use, not with the policy. Utah Code 41-12a-301(2)(a), in the version effective May 6, 2026, says every resident owner "shall maintain owner's or operator's security in effect at any time that the motor vehicle is operated on a highway or on a quasi-public road or parking area within the state"; subsection (2)(b) sets a separate duty for nonresident owners, and subsection (5) lists exceptions.
A for-hire carrier with an MC number has a federal filing in play as well. 49 CFR 387.313T(d) bars an insurer from cancelling its filing until 30 days after FMCSA receives the BMC-35 notice, and FMCSA's reinstatement FAQ, last updated May 20, 2023, says reinstating an authority requires the minimum financial responsibility and a BOC-3 on file with FMCSA. 49 CFR 387.313T(c) requires any new filing in "the full and correct name" of the carrier holding the authority.
What should you explain about a lapse in coverage when applying for a new policy?
Redoubt asks a business with a lapse to explain three things: the dates of the gap, the reason coverage stopped, and the papers that show both, starting with the last declarations page and any cancellation notice.
Utah law decides what a wrong answer does to the new policy. Utah Code 31A-21-105(2) says a misrepresentation affects the insurer's obligations when "the insurer relies on it and it is either material or is made with intent to deceive," or when the fact misrepresented "contributes to the loss." The ISO CA 00 01 11 20 business auto form is void if an insured "intentionally conceals or misrepresents a material fact" concerning the coverage form, the covered auto, the insured's interest in the covered auto, or a claim under the form.
Which papers show when the coverage lapsed and why?
The last declarations page shows the dates a policy ran, the cancellation or nonrenewal notice shows the reason, and loss runs show the claim history. Utah Code 31A-21-303(2)(d)(i), effective May 7, 2025, says a notice of cancellation for nonpayment "shall include a statement of the reason for cancellation."
Utah Admin. Code R590-124-4(1) requires an insurer to provide loss information "within 30 days of the receipt of a written request from the named insured," for the three most recent policy years, and R590-124-4(1)(b) requires the insurer to tell the first named insured about that right when the insurer cancels or does not renew. R590-124-4(2) lists what the loss information holds: closed claims with payments, open claims, and notices of occurrence, each with its date. R590-124-4(3) sets the loss information at no cost, once in any 12-month period.
| Paper | What it shows | Rule behind it |
|---|---|---|
| Last declarations page | The policy period: the dates the old policy covered | CA 00 01 11 20, IV.B.7: accidents during the policy period shown in the Declarations |
| Cancellation or nonrenewal notice | Why coverage stopped | Utah Code 31A-21-303(2)(d)(i): a nonpayment notice states the reason |
| Loss runs | Claims and notices of occurrence for the three most recent policy years | Utah Admin. Code R590-124-4(1) and (2): within 30 days of a written request |
How much does a lapse in insurance cost when you buy a new commercial auto policy?
As of October 12, 2026, Redoubt has found no published figure for what a lapse adds to a trucking premium, but a lapse can cost prior-insurance savings. Progressive says, on its commercial auto discounts page as read October 12, 2026: "You could be eligible for additional savings if you've maintained continuous insurance coverage for the last 12 months."
Utah has an assigned-risk route for commercial auto. AIPSO's Utah plan page, read October 12, 2026, says that effective September 1, 2022 National Specialty Insurance Company became "the CAIP Servicing Carrier for the Utah Automobile Insurance Plan," and gives the Plan Office number "For consumers looking for Assigned Risk insurance coverage."
What should you send for a new commercial auto policy after a lapse?
Redoubt works a business with a lapse from one list: the lapse itself, the papers behind it, and the vehicles and drivers to be insured. Send the list below by text or email; the first reply is a conversation about what the new insurer will ask about the gap and which papers answer it.
- The lapse dates and the reason coverage stopped
- The last declarations page and any cancellation or nonrenewal notice
- Loss runs for the three most recent policy years
- USDOT number, and the MC or docket number if any, with vehicle and driver counts that match SAFER
- Each vehicle and trailer: year, make, model, body type, value and VIN
- Every driver: name, date of birth, license number and class
- What the business does, and the date the new coverage has to start
