Does hired and non-owned auto cover rental cars?

Yes for your business's liability to other people, no for damage to the rental itself. Hired auto liability, the hired half of hired and non-owned auto, pays injury and property damage claims from others when you or an employee drive a rented vehicle for work. ISO's liability forms exclude property in your care, custody or control, so the rental is outside it. Damage to the rental is paid by hired auto physical damage on a business auto policy, or by the rental company's waiver or a card benefit, each on its own terms.

What does hired auto liability cover?

Your business's liability to others in vehicles it rents. ISO's Business Auto Coverage Form, CA 00 01, covers it under symbol 8, "only those 'autos' you lease, hire, rent or borrow," other than ones from your own employees, partners or LLC members. A businessowners policy adds it by endorsement: ISO's BP 04 04 covers injury or damage "arising out of the maintenance or use of a 'hired auto' by you or your 'employees' in the course of your business."

Where the rental comes with collectible liability insurance, your policy sits above it. CA 00 01 says that for an auto you don't own, its insurance "is excess over any other collectible insurance." If a commercial renter accepts Budget Truck's Basic Liability Insurance, Budget "will extend its coverage to take primary position up to 100/300/25 on third-party claims," and your own policy "will not be called on to contribute unless, and until, the 100/300/25 has been exhausted." The exception is the rental contract itself: the form is primary "for any liability assumed under an 'insured contract'," and a rental agreement counts as one, except where it makes you pay for damage to the rented auto.

Does hired and non-owned auto cover physical damage?

Not as liability coverage. CA 00 01 excludes property damage to "property owned or transported by the 'insured' or in the 'insured's' care, custody or control," and a rental agreement is not an insured contract "to the extent that it obligates you or any of your 'employees' to pay for 'property damage' to any 'auto' rented or leased by you." BP 04 04 excludes property "rented or loaned to the insured." Progressive Commercial says of its own product: "Physical damage to the hired or non-owned vehicle isn't covered."

Damage to the rental is a separate coverage, hired auto physical damage. On a business auto policy it exists when symbol 8 is entered next to comprehensive or collision, because "the symbols entered next to a coverage on the Declarations designate the only 'autos' that are covered 'autos'." The form then treats the rental as yours: any hired auto "is deemed to be a covered 'auto' you own," except one rented with a driver. It pays the lesser of actual cash value or the cost of repair. Church Mutual says of its own product: "Hired auto physical damage coverages are also available and cover damage done to the hired automobile itself."

What will the rental company charge if the rental is damaged?

More than the repair. Budget Truck's terms make a renter who declines its waivers pay "for all loss or damage to the Truck whether or not you are at fault," plus "any diminution in value of the Truck that remains after repair; actual towing, storage, impound and other related fees; Loss of Use," set at the daily rate for up to 30 days. The Utah Insurance Department tells renters to "Read the rental agreement to see if it contains language regarding administrative fees and loss of use you may be obligated to pay."

Each protection pays a different slice. Under CA 00 01 11 20, "the most we will pay for any expenses for loss of use is $30 per day, to a maximum of $900," and diminution in value is excluded. Enterprise says "Damage Waiver is not insurance"; it waives your responsibility "subject to the actions that invalidate the DW listed on the rental agreement." What pays depends on the rental agreement, the policy forms and the endorsements your carrier issued, so read them side by side before the counter.

Can I rent a van with my business insurance?

Yes, if the declarations show hired autos: symbol 1 (any auto) or 8 next to liability, and symbol 8 next to comprehensive and collision for damage to the van. A policy showing only symbol 7, the vehicles it lists, reaches a rental for liability only as "a temporary substitute for a covered 'auto' you own that is out of service." Travelers says: "Commercial auto policies don't automatically cover vehicles you don't own, even when you use those vehicles for business."

The counter will ask. Budget Truck's terms, which call whatever vehicle it assigns you the Truck, say a commercial renter "will be required to select one of the liability coverages below at Paragraphs 9.2 and 9.3 or provide a certificate of insurance." A card will not cover a cargo van: Credit Union of America's Visa guide, in effect June 1, 2025, lists "cargo vans; certain vans; vehicles with an open cargo bed; trucks" among vehicles its rental benefit excludes.

Does my insurance cover a 15-passenger van rental?

For a trip run by a church, school or business, the organization's policy is the one to check. For business travel, the Utah Insurance Department says "When traveling on business, a personal auto policy will generally not apply, so check with your employer for guidance." To a business auto policy a 15-passenger van is an auto like any other, "a land motor vehicle, 'trailer' or semitrailer designed for travel on public roads," so symbol 8 covers the group's liability for it and hired auto physical damage, if carried, covers the van. Church Mutual describes its hired and non-owned coverage as liability "when the organization rents vehicles."

Cards are the weak link for big vans. The same Visa guide says "Vans are not covered. But those designed as small-group transportation vehicles (seating up to nine (9) people, including the driver) are covered." Without hired auto physical damage, damage to the van falls to the rental company's waiver, if bought, or under terms like Budget Truck's to whoever signed the agreement.

How do I insure a rental box truck?

Bring a policy the rental company accepts, or buy its protection at the counter. Ryder's commercial rental requirements ask for liability as "Blanket coverage – Any Auto or Hired Autos" at a "Minimum $1,000,000 Combined Single Limit (CSL)," and "Blanket hired physical damage coverage required," with a $120,000 minimum for trucks where the policy does not pay actual cash value. Ryder lists "Scheduled Autos; Non-Trucking liability" as unacceptable. Ryder Truck Rental and its affiliates must be endorsed as additional insured and loss payee "for all vehicles rented, leased, or provided as a substitute."

A policy written on scheduled autos, only the trucks it lists, is one Ryder names as unacceptable. Budget Truck instead lets commercial renters buy its liability coverage. Damage to the box truck still needs hired auto physical damage or the rental company's waiver.

What insurance do I need to rent a semi truck?

Ryder asks a renter's own policy for liability on "Any Auto or Hired Autos" and lists scheduled autos as unacceptable. One way a trucking company meets that is ISO's Motor Carrier Coverage Form, CA 00 20, with its hired autos symbol, 68, "Only those 'autos' you lease, hire, rent or borrow"; for physical damage a rented unit "is deemed to be a covered 'auto' you own." It also makes the lessor an insured while a leased power unit "is used in your business as a 'motor carrier' for hire," unless the lease has the lessor hold you harmless. Ryder's physical damage minimum for a tractor, where the policy does not pay actual cash value, is $150,000.

Ryder also lists non-trucking liability as unacceptable. The limit has to fit the work: for freight hauled for hire across state lines, 49 CFR 387.9 sets $750,000 as the federal minimum for for-hire, interstate carriage of nonhazardous property in vehicles of 10,001 pounds GVWR or more, and Ryder asks for $1,000,000.

Frequently asked questions

My employee rented the car in their own name. Is it still a hired auto?

Not automatically: the standard form covers autos "you" rent, meaning the named insured. ISO's CA 20 54, Employee Hired Autos, makes the employee an insured and treats an auto rented in the employee's name for your business as yours for hired auto physical damage. Ask whether your policy carries it.

Does rental reimbursement pay for a rental on a business trip?

No. ISO's CA 99 23 pays for a rental "because of 'loss' to a covered 'auto'": a substitute while your own vehicle is out after a covered loss.

Is a rental outside the United States covered?

Partly. CA 00 01 11 20 covers a private passenger auto rented without a driver for 30 days or less anywhere in the world, if liability is decided in a suit in the United States, its territories, Puerto Rico or Canada. Enterprise says its damage waiver does not apply in Mexico.

What if we rent a vehicle for six months or more?

If the written agreement runs at least six months without a driver and requires you to provide primary insurance, CA 00 01 treats it as an auto you own, not a hired one.
