A vehicle was sold, totalled, parked for the season or moved, and the policy has to follow it

Total loss commercial vehicle

A business whose totaled work truck carried physical damage cover on the policy is paid its actual cash value, less the deductible, and adds the replacement by endorsement. ISO's business auto form, CA 00 01 11 20, pays only for the autos its declarations symbols designate for Collision, Comprehensive or Specified Causes Of Loss. It caps a payment at the lesser of actual cash value at the time of loss, adjusted for depreciation and physical condition, or the cost of like kind and quality. A carrier's own forms may differ from these ISO specimens, and its declarations decide.

What makes a work truck totaled, and how is the payout calculated?

A totaled truck is paid its actual cash value less the deductible under ISO's CA 00 01 11 20, if the policy carries physical damage cover on it. Section I of the form says "The symbols entered next to a coverage on the Declarations designate the only "autos" that are covered "autos"," and Section III.A pays for loss to a covered auto under Comprehensive, Specified Causes Of Loss or Collision, so a truck insured for liability alone gets no payment for its own damage.

Actual cash value is the truck's value at the time of the loss, adjusted for depreciation and physical condition: CA 00 01 Section III.C.1 caps a payment at the lesser of "The actual cash value of the damaged or stolen property as of the time of the "loss"" or the cost of repair or replacement "with other property of like kind and quality," and III.C.2 says "An adjustment for depreciation and physical condition will be made in determining actual cash value in the event of a total "loss"." Section III.D subtracts "the applicable deductible shown in the Declarations," and under IV.A.4 a payment includes "the applicable sales tax."

A total loss is a truck the insurer pays for instead of repairing, and Utah's title law sets its own test. Utah Code 41-1a-1001(8), effective October 1, 2019, defines a salvage vehicle as one "damaged by collision, flood, or other occurrence to the extent that the cost of repairing the vehicle for safe operation exceeds its fair market value," or one "declared a salvage vehicle by an insurer," so the insurer's declaration alone puts the truck in that class.

What each ISO coverage pays after a work truck is totaled

Physical damage (CA 00 01 11 20, III.C)Actual cash value, or like-kind repair if less, minus the deductibleThe declarations show the truck for Collision, Comprehensive or Specified Causes Of Loss
Auto loan/lease gap (CA 20 71 11 20)The unpaid loan or lease balance, less the physical damage paymentThe truck is scheduled with a gap premium
Rental reimbursement (CA 99 23 10 13)A rental from 24 hours after the loss, no deductibleThe truck is scheduled with a premium and no spare autos are available

Can you keep a totaled truck after the insurance settles?

A business keeping a totaled truck declared salvage in Utah surrenders the title within 10 days of settlement for a salvage certificate, under Utah Code 41-1a-1005. Whether the insurer takes the truck is the insurer's option under CA 00 01 11 20 Section IV.A.4, which lets it "Take all or any part of the damaged or stolen property at an agreed or appraised value," and Section IV.A.2.c.(3) requires the business to "Permit us to inspect the covered "auto" and records proving the "loss" before its repair or disposition."

Utah Code 41-1a-1005(1)(b), effective October 1, 2019, sets the steps when the owner keeps the truck: the insurer notifies Utah's motor vehicle division of the retention within 10 days after settlement, and "The owner shall within 10 days after the day on which settlement of the loss occurs surrender to the division the properly endorsed certificate of title." The division then issues a salvage certificate in the owner's name, and 41-1a-1001(7)(b) says "A salvage certificate is not valid for registration purposes." When the insurer takes the truck instead, 41-1a-1005(1)(a)(i) has the insurer surrender the endorsed title within the same 10 days. Section 41-1a-1005(3) excludes a vehicle "that has an undamaged, wholesale value of $2,000 or less."

A kept truck carries its history into any later sale. Utah Code 41-1a-1004(2), effective May 12, 2020, requires a seller of a vehicle "knowingly declared a total loss by an insurance company" to give the buyer written notice before the sale.

Who gets the check when a financed truck is totaled, and does gap insurance cover the rest?

Gap coverage under ISO's CA 20 71 11 20 pays the loan balance a total loss settlement leaves unpaid, only on a truck scheduled for it. Where the policy carries ISO's loss payable clause, CA 99 44 10 13, the settlement itself goes to both: "We will pay, as interest may appear, you and the loss payee named in the policy for "loss" to a covered "auto"."

CA 20 71 applies to a truck shown in its schedule "for which a specific premium charge indicates that Auto Loan/Lease GAP Coverage applies." After a total loss it pays "any unpaid amount due on the lease or loan for a covered "auto"," less the physical damage payment and listed items such as overdue payments, warranties bought with the loan and carry-over balances from earlier loans. CA 20 71 also makes itself excess over other collectible insurance, "including but not limited to any coverage provided by or purchased from the lessor or any financial institution."

Ask the lender for the payoff figure as of the settlement date and give the adjuster the loss payee's name as the loan papers print it.

How long will insurance pay for a rental truck after a total loss?

Rental reimbursement under ISO's CA 99 23 10 13 pays for a rental from 24 hours after the loss, and only on a policy that bought it. CA 99 23 "provides only those coverages where a premium is shown in the Schedule" and pays expenses "beginning 24 hours after the "loss"" until the lesser of the days "reasonably required to repair or replace the covered "auto"" or the days in the schedule, capped at the daily and per-period amounts shown. "No deductibles apply to this coverage," and "This coverage does not apply while there are spare or reserve "autos" available to you for your operations."

The business auto form's own transportation expense extension does not reach a totaled work truck: CA 00 01 11 20 Section III.A.4.a pays "up to $30 per day, to a maximum of $900" only after "the total theft of a covered "auto" of the private passenger type." A borrowed truck is not automatically covered either: CA 00 01 Section I.C.3 makes a temporary substitute a covered auto only where the policy provides Covered Autos Liability Coverage, for liability only and not for damage to it, and a carrier's own form may differ, so ask the insurer before a borrowed truck goes to work.

How do you replace a totaled vehicle on a commercial auto policy?

A replacement truck joins the policy by endorsement under ISO's Common Policy Conditions, IL 00 17 11 98. The form says "This policy's terms can be amended or waived only by endorsement issued by us and made a part of this policy." Under CA 00 01 11 20 Section I.B.2, a policy written on symbol 7 covers a replacement only if "it replaces an "auto" you previously owned that had that coverage" and "You tell us within 30 days after you acquire it."

Ask the insurer to take the totaled truck off the schedule and to name the replacement's lender or lessor when the replacement goes on. Utah Code 31A-21-303(8)(a), effective May 7, 2025, has an insurer cancelling a motor vehicle policy for nonpayment notify a lienholder "if the insurer has been provided the name and mailing address of the lienholder." The plates can follow the business: Utah Code 41-1a-701, effective January 1, 2025, expires the registration when the title transfers and gives the owner 20 days to return the plates or "have the plates assigned to another vehicle."

What do you send to put the replacement truck on the policy?

Redoubt starts a replacement from seven items: the new vehicle, its lender, the in-service date, the current policy, the drivers, the totaled truck and the business. Text the list below with the date you need cover by, and we will say what can be bound now, what needs the carrier, and what to send back.

  • Replacement vehicle: year, make, model, body type and price
  • The replacement's lender or lessor, with the name and mailing address the loan papers print
  • The date the replacement goes into service
  • The current declarations page, or the dates of prior coverage
  • Every driver: name, date of birth, license number and class
  • The totaled vehicle's year, make, model and VIN, the claim number, and its lender
  • The USDOT or MC number if the business has one, and a line on what the business does

Frequently asked questions

Should you cancel the policy after a total loss?

Not the whole policy. ISO's IL 00 17 11 98 says a cancellation notice states its date and "The policy period will end on that date," for every vehicle on the policy, and a refund to an insured who cancels "may be less than pro rata." Take the totaled truck off by endorsement instead.

What if you disagree with the insurer's value for the totaled truck?

Either side can demand an appraisal under CA 00 01 11 20 Section IV.A.1: each picks a competent appraiser, the two pick an umpire, and a decision agreed by any two binds. The insurer keeps its right to deny the claim.
