How to verify an insurance agent

A business owner weighing an unfamiliar agency found online should look it up by name in the Utah Insurance Department's Licensee Search before sending vehicle or driver details. Utah Code 31A-23a-103 bars anyone not exempt from offering a producer's services in Utah without a license, and 31A-23a-106 ties each license to lines of authority. By the Utah Code 31A-1-301 definitions, a commercial auto policy's liability falls under the casualty line and its physical damage under the property line, and personal lines cover only noncommercial insurance for an individual or family. Then ask how the agency is paid: Utah Code 31A-1-301 calls a producer paid by the insurer an agent and one paid only by the customer a broker.

How do you tell if an insurance agency is legit?

An insurance agency is legitimate in Utah when the agency and the person quoting you each hold a current Utah license with the right lines of authority. Utah Code 31A-23a-103(1)(a) says a person may not "perform, offer to perform, or advertise any service as a producer" in Utah without a valid individual or agency license, and Utah Code 31A-23a-301 requires an insurance organization acting as a producer to be licensed as an agency.

The agency's license and the agent's license are two separate checks. Utah Code 31A-23a-302(5) says a licensed agency may act "only through an individual who is licensed under this chapter to act in the same capacity," so the person on the phone needs a license of their own, not only the firm's.

A licensed agency also has a registered place of business. Utah Code 31A-23a-412(1) requires every licensee to register with the Utah Insurance Commissioner the address and telephone numbers of its principal place of business and a business email address, and to report a change within 30 days; the address and phone on an agency's website should match the ones on its license record.

How do you check if an insurance agent is licensed in Utah?

The Utah Insurance Department's Licensee Search shows whether a named agent or agency holds a current Utah insurance license, and with which lines. The Department says the tool exists so you can "verify that a specific agent or agency is currently licensed in Utah," and its Finding an Agent page says to check license status with Licensee Search "to verify they have a license for the product they are selling." The tool searches "by Location, Name or License Number"; for an agency, pick Search by Name and then Search by Company/Agency.

An agency's Licensee Search record, as read on October 12, 2026, shows these fields; check each against what the website and the person on the phone said:

  • Name and aliases: the legal name, and any other name the agency trades under
  • Business address, phone and email registered with the Department
  • Status, issue date and expiry date of the license
  • Lines of authority, such as Property and Casualty, each with its own status and issue date
  • Active agent associations: the licensed individuals listed under the agency
  • Active company affiliations: company names, addresses, types and active dates, where the record lists any

What license does an agent need to sell commercial auto insurance?

By Utah Code 31A-1-301's definitions, commercial auto liability falls under the casualty line of authority and physical damage under the property line. Utah Code 31A-23a-106(1)(b) says a license type and its line of authority describe "the lines of business that a licensee may sell, solicit, or negotiate," and 31A-23a-106(2)(a) lists property, casualty and personal lines as separate producer lines. Utah Code 31A-1-301 defines each line; the table applies those definitions to a business auto policy.

By those definitions, a Licensee Search record with Casualty active reaches the liability on a business auto policy, Property active reaches its physical damage, and personal lines alone reach neither, because personal lines are defined as noncommercial cover for an individual or a family.

What is the difference between an insurance agent and a broker, and how do they get paid?

Utah law sorts insurance agents and brokers by who pays them: an agent is paid by the insurer, a broker only by the customer. An insurance producer is "a person licensed or required to be licensed under the laws of this state to sell, solicit, or negotiate insurance," under Utah Code 31A-1-301(102)(a). The same subsection names a producer "compensated directly or indirectly by an insurer" a producer for the insurer, called an agent, and a producer "compensated directly and only by an insurance customer or an insured" a producer for the insured, called a broker.

Agents also differ in how many insurers they can reach. The Utah Insurance Department's Finding an Agent page says a captive agent "represents a single insurer, or single fleet of insurers," and an insurance broker "searches the marketplace in the interests of clients, not insurance companies." The two sources use "broker" differently: Utah Code 31A-1-301 defines a broker by who pays it, the Department by whose interests it serves and how many insurers it reaches. Redoubt is an independent agency that helps evaluate coverage and carrier options for the operation; ask any agency which insurers it can place your operation with.

A Utah agency's fee on top of commission is limited by Utah Code 31A-23a-501. Subsection (2)(b) limits the fee to "actual or reasonable expenses incurred for services" and requires it to be applied uniformly to a class of business or a service, and subsection (6) bars a fee for a service the licensee must perform to earn its commission. Ask for any fee in writing before sending an application.

How do you check the insurance company behind the quote?

Check the insurer named on a quote separately from the agency, by name in the same Licensee Search. Utah Code 31A-23a-115(1)(a) says an insurer "shall appoint" an agency it contracts with "in order for the licensee to do business for the insurer in this state," and Utah Code 31A-23a-408 bars anyone from representing that they act for an insurer unless a written agency contract is in effect and the insurer appoints them. The Utah Insurance Department says Licensee Search holds records for "agents, agencies, and companies."

Surplus lines quotes need one more question. The Utah Insurance Department describes surplus lines as "a supplemental market of insurance companies that do not have a certificate of authority to write insurance in Utah"; ask the agency whether the quote is from an admitted insurer or a surplus lines insurer.

Premium paid to the agency that placed the policy counts as paid to the insurer. Utah Code 31A-23a-410(1) says that when an insurer assumes a risk and the premium is received by "a licensee who placed the insurance," the insurer "is considered to have received the premium" and is liable for covered losses; subsection (2) removes that protection when the insured pays a licensee knowing the licensee does not intend to submit the premium.

What should you send an agency on first contact, and what happens next?

A first contact with Redoubt needs four details, and the first reply is a conversation about the business. Send the list below by text or email. Redoubt is an independent insurance agency, not the Utah Insurance Department and not an insurer, and it starts with the work the business does, the contracts or filings involved, and the deadline in front of it.

On that call Redoubt says what can be bound now, what needs the carrier, and what to send back.

  • Your name and a phone number Redoubt can call
  • The business name and what the business does
  • The number of vehicles the business runs
  • The current insurer and the policy's renewal date

Frequently asked questions

Is a policy void if the agent who sold it was not licensed?

No. Utah Code 31A-23a-103(3) says "An insurance contract is not invalid as a result of a violation of this section"; the license rule binds the seller, not the policy.

What is an NPN?

A National Producer Number is the identifier NIPR's Producer Database gives a licensee; NIPR says an NPN is "a unique NAIC identifier assigned during the licensing application process." NIPR also says "Licenses are issued by the regulating state," and Utah's are searchable by license number in Licensee Search.

What if Licensee Search does not load?

The Utah Insurance Department's Licensee Search page says that if the tool is down, or on a mobile device, similar information is on Sircon, linked from the same page.

Can you file a complaint against an insurance agent in Utah?

Yes. The Utah Insurance Department's complaints page says a person unable to resolve a problem "with your insurance company or agent" may contact its staff or file a written complaint, and its Administrative Actions page lists actions against licensees for the past 10 years plus the current year.
