The business is starting, changing hands or changing what it does, and the policy has to describe it

General liability vs commercial auto

For a business with general liability and commercial auto from different providers, the policies fit when every auto claim general liability excludes lands on a covered auto. ISO's general liability form CG 00 01 12 25 excludes injury and damage from any auto owned or operated by, rented or loaned to an insured, and ISO's business auto form CA 00 01 11 20 pays for accidents from the ownership, maintenance or use of a covered auto. Both forms exclude injury to the business's own employees, which Utah Code 34A-2-401 puts on the employer and the employer's insurance carrier. ISO's CU 00 01 04 13 umbrella covers an auto only where the scheduled auto policy applies.

Does general liability cover vehicles and auto accidents?

ISO's CG 00 01 12 25 general liability form excludes injury and damage from autos owned or operated by, rented or loaned to an insured, apart from two exceptions. Exclusion g takes out bodily injury or property damage arising out of "any aircraft, "auto" or watercraft owned or operated by or rented or loaned to any insured," and says "Use includes operation and "loading or unloading"." CG 00 01 12 25 applies the exclusion even when a claim alleges negligent hiring, supervision or training of the driver.

Two exceptions in CG 00 01 12 25's exclusion g return a vehicle-related claim to general liability: parking an auto the business does not own, rent or borrow on or next to premises it owns or rents, and the operation of machinery attached to a land vehicle that would otherwise be mobile equipment. For any other auto loss that exclusion g does not reach, the form's Other Insurance condition makes general liability excess. ISO's businessowners form BP 00 03 08 24 carries the same auto exclusion, in the same words, in its Section II exclusion g.

What does commercial auto cover that general liability does not?

Commercial auto covers liability for accidents from the ownership, maintenance or use of a covered auto, the claims general liability leaves out. ISO's CA 00 01 11 20 business auto form says "We will pay all sums an "insured" legally must pay as damages because of "bodily injury" or "property damage"" caused by an accident and "resulting from the ownership, maintenance or use of a covered "auto"." A covered auto is a vehicle brought in by the symbol printed next to each coverage on the auto declarations; CA 00 01 11 20 says those symbols "designate the only "autos" that are covered "autos"."

CA 00 01 11 20 and CG 00 01 12 25 hand claims to each other at named exclusions, and the table sets six claims against the two forms.

Can you have double insurance coverage, and which policy pays first?

Two policies can both answer one claim, and each form's Other Insurance clause decides which pays first and how the rest is split. ISO's CA 00 01 11 20 says "For any covered "auto" you own, this Coverage Form provides primary insurance. For any covered "auto" you don't own, the insurance provided by this Coverage Form is excess over any other collectible insurance." When two policies cover on the same basis, both primary or both excess, CA 00 01 11 20 pays "only our share," the proportion its limit bears to the total of all the limits. CG 00 01 12 25 is primary "except when Paragraph b. below applies," and paragraph b makes it excess in listed cases, including an auto loss that its exclusion g does not reach.

Three clauses change that order. CA 00 01 11 20's liability coverage is primary for liability the business assumed under an insured contract, whoever owns the auto. Two policies from one insurer or its affiliates applying to the same accident pay no more than "the highest applicable Limit of Insurance under any one Coverage Form or policy," except a policy that insurer or an affiliate issued "specifically to apply as excess insurance over this Coverage Form." ISO's BOP hired and non-owned auto endorsement, BP 04 04 01 10, is "excess over any primary insurance covering the "hired auto" or "non-owned auto"."

How do you check several policies from different providers for coverage gaps?

A coverage gap check across several providers reads the same five entries on every declarations page and form, policy by policy. The forms quoted on this page are ISO's specimens; the check reads the forms and endorsements listed on the policies actually issued.

  • Named insured: the legal names on each declarations page, because CA 00 01 11 20, CG 00 01 12 25 and CU 00 01 04 13 each say "you" and "your" refer to the Named Insured shown in the Declarations
  • Covered auto symbols: the symbol next to each coverage on the auto declarations, read against every vehicle the business owns, hires or borrows
  • Exclusion hand-offs: autos go from general liability to auto, mounted machinery from auto to general liability, employee injury from both to workers compensation, goods in the truck to inland marine or cargo
  • Underlying policies: the policies and limits in the umbrella's Schedule of underlying insurance, which CU 00 01 04 13 requires to be kept in force without reduction of coverage or limits, apart from aggregate limits reduced by paid claims
  • Dates and notices: the renewal and cancellation dates on each policy; Utah Code 31A-21-303, in the version effective May 7, 2025, makes an insurer's cancellation effective no sooner than 30 days after written notice when the reason is not nonpayment, 10 days for nonpayment on a commercial policy, and 10 days for a policy not yet renewed and in effect under 60 days

How does a commercial auto umbrella fit over the auto and general liability policies?

ISO's CU 00 01 04 13 umbrella covers an auto only where the auto policy listed in its Schedule of underlying insurance applies. The form defines a covered auto as "only those "autos" to which "underlying insurance" applies," and its exclusion f removes injury or damage from "any "auto" which is not a "covered auto"". Underlying insurance is any policy "listed in the Declarations under the Schedule of "underlying insurance"."

CU 00 01 04 13 expects the scheduled policies to stay in place. Its Maintenance Of/Changes To Underlying Insurance condition requires underlying insurance "maintained in full effect without reduction of coverage or limits," except for aggregate limits reduced by paid claims, and if a scheduled policy is not maintained, the umbrella "will apply as if the "underlying insurance" were in full effect." The same condition requires written notice to the umbrella insurer if any underlying policy "is cancelled, not renewed, replaced or otherwise terminated," which includes moving the auto policy to a new provider.

What do you send to have the policies reviewed together, and what happens next?

The packet for a commercial auto quote beside existing general liability, BOP or umbrella policies is every declarations page, the named insureds, the vehicles and the drivers. Text the list below to Redoubt; the reply says what can be bound now, what needs the carrier, and what to send back.

  • Every current declarations page: auto, general liability, BOP and any umbrella
  • The named insured and FEIN on each policy
  • Each vehicle and trailer: year, make, model, body type and value
  • Every driver: name, date of birth, licence number and class
  • USDOT or MC number, if any, and a paragraph on what the business does
  • The date any change has to take effect

Frequently asked questions

Does workers comp cover auto accidents?

For an employee hurt in a crash while working, Utah Code 34A-2-401(1) pays compensation for an injury by accident in the course of employment "wherever such injury occurred," and 401(2) puts that on the employer and the employer's insurance carrier. CA 00 01 11 20 and CG 00 01 12 25 both exclude the injury.
