A lender or dealer will not release the truck until the insurance names it

Financed truck insurance

A lender financing a truck commonly requires physical damage (comprehensive and collision) on it for the life of the loan, a deductible at or under its cap, the lender named on the policy as loss payee, and proof before it funds. Published terms show the range: Mountain America Credit Union in Utah caps each deductible at $2,500 and requires a loss payable endorsement naming it as lienholder; Amur Equipment Finance caps the deductible at $1,000 up to $250,000 of equipment and wants 30 days' notice before cancellation on titled equipment. Liability is a separate legal requirement the lender's terms do not replace.

What insurance does a lender require on a financed truck?

Whatever the insurance paragraph in your loan or lease says, so read it before you shop. Most cover the same five things: physical damage, a maximum deductible, a value to insure, how the lender is named, and notice before cancellation. The figures differ by lender.

Mountain America Federal Credit Union, based in Sandy, Utah, has borrowers sign an Agreement to Provide Insurance. The coverage "must at least provide comprehensive and collision coverage," the policy must contain "a loss payable clause endorsement naming the lender as lienholder," and it must "remain in force for the entire term of the loan." The deductible "cannot exceed $2,500.00 for comprehensive or $2,500.00 for collision coverage."

Amur Equipment Finance publishes a tiered list. The insured value must be "equivalent to at least its invoice price," liability must be at least $1,000,000 per occurrence, the certificate must list the equipment with serial numbers, and the maximum deductible is $1,000 up to $250,000 of equipment value, with higher deductibles allowed on larger deals. A first-time buyer of insurance for the equipment needs a term of at least six months from Amur's last funding date.

Should the lender be loss payee, additional insured or lienholder?

Loss payee, because the lender's stake is the truck. Progressive Commercial puts it this way: loss payees "are typically tied to loan or lease agreements. When added to your policy, the insurer pays them first, up to what they're owed." It adds that a loss payee "isn't protected against lawsuits because coverage applies only to the property itself."

On a commercial auto policy the standard ISO endorsement is the Loss Payable Clause, CA 99 44. The insurer pays "you and the loss payee named in the policy" for loss to a covered auto, "as interest may appear," and if the insurer cancels, it mails the loss payee "the same advance notice." Lienholder is the title word for the same lender, which is why Mountain America asks for a loss payable endorsement "naming the lender as lienholder."

Additional insured is a liability role. A lender that also wants it says so separately, as Amur does, and lessors such as Ryder ask for both. Copy the lender's legal name and mailing address exactly as its paperwork prints them; Amur, for one, spells out the wording it wants, down to "its successors and/or assigns."

What does the lender need to see before the dealer releases the truck?

Proof that the policy is bound, with the truck and the lender on it, before the money moves. Amur heads its titled-equipment list "Required Prior to Funding." McKinney Trailers, for trailers it leases or rents, wants the certificate "provided and evidenced to us prior to completing the contract and removing the equipment from our facility," and Ryder asks for it at the local office "before pickup." A late binder holds up the funding and the pickup with it.

The proof should show the VIN, physical damage and its deductible, the value insured, the lender's exact name and role, and the policy dates. Mountain America's agreement asks the borrower to have the agent "forward a copy of my policy to the lender," not just a certificate. A certificate reports the policy; it does not add the lender to it. Under ISO's common policy conditions the terms change "only by endorsement issued by us," so the loss payable endorsement has to be on the policy itself.

Liability is a separate requirement. The Mountain America agreement says it provides no coverage for "Bodily Injury and Property Damage Liability insurance," and Utah Code 41-12a-301 requires every resident owner to "maintain owner's or operator's security in effect at any time that the motor vehicle is operated on a highway." A truck driven off the lot needs both.

How do I add a financed truck to a policy I already have?

Call the insurer before you sign, not after. Under ISO's Business Auto Coverage Form, a policy written on symbol 7 (specifically described autos) covers a truck bought mid-term only if the insurer already covers every auto you own for that coverage, or the new truck replaces one that had it, and you tell the insurer within 30 days. If only some of your trucks carry physical damage, a new one has none automatically, and the lender wants it shown before funding anyway.

The duty to keep the lender informed runs for the whole loan. Mountain America's agreement says: "Upon obtaining insurance or changing insurance, I will have my agent forward a copy of my policy to the lender immediately." Keep any deductible change inside the loan's cap.

What happens if my insurance lapses while I still owe on the truck?

The lender hears about it, and it can buy insurance for itself and charge you. In Utah, an insurer cancelling a motor vehicle policy for nonpayment "shall provide notice of nonrenewal or cancellation to a lienholder if the insurer has been provided the name and mailing address of the lienholder." ISO's loss payable clause sends the loss payee the same advance notice when the insurer cancels, and Amur asks for 30 days' written notice from the carrier before any cancellation on titled deals.

Mountain America's agreement spells out lender-placed insurance. If the borrower fails to provide the required insurance as of the loan's effective date, the lender "may purchase any type of insurance it feels necessary to protect its interest in the collateral," its cost and interest are added to the loan balance, and that insurance "will never provide an amount of insurance greater than the amount I owe on my loan." It includes no liability coverage. Ascentium Capital describes the same arrangement for financed equipment: "automatic insurance" under its own policy if you don't provide yours, and "you will be billed for the expenses."

To get a lender-placed policy taken off, put a policy in force that meets the loan's terms, send the lender the proof, and ask in writing how it handles the charge for the period your policy covers.

What happens if a financed truck is totaled and I owe more than it is worth?

The lender is paid first, and the balance left over is yours unless the policy had gap-type coverage before the loss. Progressive Commercial says the insurer pays the loss payee "first, up to what they're owed." Great West Casualty explains where a shortfall comes from: a commercial auto policy "will pay you the lesser of the stated limit or the actual cash value of your truck if it is a total loss, but it won’t pay off any remaining loan or lease balance."

Two kinds of endorsement fill that gap. ISO's Auto Loan/Lease Gap Coverage, CA 20 71, pays "any unpaid amount due on the lease or loan" after a total loss, less the physical damage payment and listed items such as overdue payments and carry-over balances from earlier loans. Great West sells a Lease Value and Financed Value endorsement and gives this example: "if you owe $50,000 on your truck’s loan and your semi is worth $45,000, this endorsement will pay the $5,000 gap, minus your deductible."

Sources: 23, 29, 28, 30

What changes when the truck is paid off or sold?

The lender's insurance requirement ends with the loan; Mountain America's runs for "the entire term of the loan." After payoff, ask the insurer to remove the loss payee by endorsement, since the policy's terms change "only by endorsement issued by us," and then decide whether to keep physical damage on its own merits rather than because a loan requires it.

In Utah, the lien comes off the title in one of two ways. The DMV says "If your financial institution is an E-Lienholder, they will remove their interest from your title automatically." With a paper title the lienholder has signed off, you apply for a corrected title, and the DMV says the lien release "can take place directly on the title, duplicate title application, or a separate letter."

Selling a truck you still owe on has its own steps; the sale page covers them.

What to send

What to send to insure a financed truck

One message with all of this lets the insurer, the lender and the dealer work from the same facts.

  1. 1.The insurance paragraph from the loan or lease, or the lender's requirements letter
  2. 2.The lender's legal name and mailing address exactly as it wants them printed
  3. 3.The role it asks for: loss payee, lender's loss payable, lienholder or additional insured
  4. 4.The highest deductible the lender allows and the value it wants insured
  5. 5.The VIN, year, make and model, and the purchase price or financed amount
  6. 6.The funding or pickup date, and who at the lender or dealer gets the proof
  7. 7.Your current policy, if the truck is joining one
  8. 8.Each driver's license, and your USDOT and MC numbers if you have them
Frequently asked questions

Is lender-placed insurance the same as my own physical damage?

No. Mountain America's agreement says the limited insurance it may order never provides more than the amount owed on the loan and provides no bodily injury or property damage liability coverage. It protects the lender's interest in the truck, its cost is added to the loan, and it does not meet Utah's requirement to carry owner's security while the truck is driven.

Does the lender require gap coverage?

None of the published lender requirements quoted on this page ask for it. Gap or financed value coverage protects you, not the lender, when the loan balance is above what the policy pays on a total loss, and it has to be on the policy before the loss happens.
